Description

During the course, some general issues in the context of the 1980 Vienna Convention on Contracts for the International Sale of Goods (CISG) will be discussed, in particular basic issues related to the conditions for the application of the CISG and the autonomy of the parties’ will (the possibility of including and excluding the CISG). In addition, issues related to the methodology of interpretation and application of the provisions of the Convention will be discussed, as well as basic issues related to the interpretative directives of the Convention, as well as rules on the interpretation of unilateral statements or conduct of the parties. The importance of practices and customs will be discussed commercial transactions against the background of the CISG and the basic issues related to the principle of freedom in the form of the sales agreement and the principle of admissibility of any means of evidence in proving the fact of conclusion and content of the contract. During the class, the lecturer will discuss the basic issues related to the procedure of concluding and modifying the contract against the background of CISG, as well as the basic issues related to the rights and obligations of the parties, as well as legal remedies of the parties.
